1. Subject

This distance selling agreement is executed by and between the Seller (“WPCrawl” “We” “Our”) and the customer (“BUYER” “Customer” “Member” “You” “Subscriber”) logged into the Website and/or Member customer at the time of approval by the Member in the electronic environment with respect to the utilization of the Website. The Member agrees and declares that she/he has already read the Terms & Conditions and Distance Selling Agreement entirely and understands the content of the Agreement completely and approves all the provisions of the same through login to the Website and/or becoming a Member.

In order to create a subscription on the Site, you will be required to provide your personal details. In particular, you must provide your real name, phone number, email address, and other requested information as indicated. Furthermore, you will be required to provide payment details that you represent and warrant are both valid and correct and you confirm that you are the person referred to in the Billing information provided. Services subscribed by the BUYER are for personal use and should not be re-sold, shared, or used for commercial purposes or any other commercial benefit.

2.2 BUYER:

The customer is the member of the site WPCrawl. The information provided in the membership will be taken as the basis.

3. Services Subject to the Contract

WPCrawl is a software company providing Internet & Website services on speed optimization, performance improvements and custom development. WPCrawl.com is a subscription-based SaaS business helping WordPress users efficiently build up website & CDN cache through an easy-to-use user interface.

This Distance Sale Contract (hereinafter briefly referred to as the “Contract”) is prepared in accordance with the applicable Consumer Protection and the Regulation on Distance Contracts. The parties accept and declare that they know and understand their obligations and responsibilities arising from the law on Consumer Protection and the Regulation on Distance Contracts. The main features (capabilities, working schedule, outputs) of the service are fully described on WPCrawl website.

4. General Provisions

4.1 Customer acknowledges and agrees that the Customer has read and fully understood the preliminary information about the basic qualifications, selling price and payment method as well as the delivery of the service subject to this Contract as indicated in Article 3 and that the Customer has provided the required confirmation in the electronic environment.

4.2 Announced prices and promises are valid until updated and changed. The prices announced for a period are valid until the end of the specified period. The price of the service that the Customer has the obligation to pay and purchased through the website is collected by WPCrawl from the Customer. The Customer will have duly and fully paid the price of the service he/she has received by paying the fee for the service he/has chosen through the website. WPCrawl is the primary and sole addressee for the Customer.

4.3 If the service subject to the contract is to be delivered to another person/legal entity other than the Customer, WPCrawl shall not be liable for the refusal of the delivery by the said person/legal entity where applicable.

4.4 Customer is aware that the right of withdrawal of the service is not applicable for the service provided on the website platforms. Customer accepts that he/she is aware of the statement that “the contracts related to the services performed instantly in the electronic environment and the goods delivered to the consumer instantly”.

4.5 In addition to the terms of this Agreement, the parties accept, declare and undertake that they accept the provisions of Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.

4.6 All articles of this agreement have been read and accepted by the Customer and this agreement enters into force on the date it is approved electronically by the Customer.

5. Delivery of the Service and Delivery Method

The contract has come into force after being approved by the Customer in an electronic environment and is executed by delivering the service purchased by the Customer from WPCrawl to the Customer. WPCrawl is obliged to provide the service in line with the Customer information specified on the website.

6. Notifications and Evidence Agreement

Any correspondence between the Parties under the contract shall be made via email, except for the compulsory cases listed in the legislation. In the disputes that may arise from the Contract, the Customer acknowledges, declares and undertakes that the Seller’s official books and commercial records, electronic information and computer records kept in its database, on its servers, will constiture a binding, conclusive and exclusive evidence. Also the Customer acknowledges, declates and undertakes that this article is in the nature of an evidence contract within the meaning of Article 193 of the Code of Civil Procedure.

7. Right of Withdrawal

Pursuant to the provisions of the Distance Contracts Regulation published on 27 November 2014 and numbered 29188 The Customer acknowledges that right of withdrawal is not applicable for the services that are instantly delivered to the Customer.

8. Privacy

The information specified in this Agreement by the Customer and the information notified to the Seller for payment will not be shared by the Seller with third parties. The Seller can explain this information only in the presence of administrative/legal obligations. Credit card information is only used to securely transmit to relevant banks during the collection process handled by IYZICO and is never stored on our databases. Information such as the Customer’s email address and telephone is used only by the Seller for standard communication and information procedures. In some periods, campaign information, information about new products, and promotional information may be sent to the BUYER after confirmation and approval of such communication on the website.

9. Authorized Courts

In disputes related to this Agreement, the Consumer Problems Arbitration Committees in the BUYER’s settlement are authorized up to the value announced by the Ministry of Industry and Trade every year. The Consumer Courts are authorized for disputes over this value.

In case the order is realized, the BUYER is deemed to have accepted all terms of this contract.
